Dispute Resolution

The Firm has a robust litigation team inspired by the philosophy of careful selection and competent representation. Our experience includes handling contentious cases through litigation in courts or Alternative Dispute Resolution (ADR) Mechanisms such as arbitration and mediation which are gaining prominence in our jurisdiction. We have acted for clients across key sectors on various matters that include construction & property disputes, employment and labour relation disputes, shareholder disputes, intellectual property cases, land & environmental law cases, tax & financial cases, public procurement and general commercial disputes. We have represented clients in various dispute resolution forums including tribunals, review boards and the courts.

 The team in charge of ADR is multi-disciplinary and has wide experience both as counsel and seasoned arbitrators. One of the Partners is a Fellow of the Chartered Institute of Arbitrators (FCIArb). Arising from the confidential nature of arbitration, specific details of the matters handled may not be shared.

 Some of our representative matters include the following:

  1.  One of the Partners is a Fellow of the Chartered Institute of Arbitrators (FCIArb.) and has been appointed as a Sole Arbitrator in arbitration matters ranging from Construction, Land, Consultancy Services, and general Contractual Claims. The Firm has therefore acted as Counsel representing parties in Arbitral Tribunals.

  2. One of the Partners is an accredited mediator having undergone extensive training as the Mediation Training Institute.

  3. Acted as counsel for a developer in a matter involving public procurement administrative review of an award of tender for construction works advertised and valued at Kes 230 million.

  4. Acted as counsel in an arbitration dispute for a developer in a matter involving a county government, representing a developer in a claim of damages by former tenants for illegal eviction, with the project valued at Kes 5.6 billion.

  5. Represented a county government in defending the taxation suit, with the subject matter valued at Kes 4 billion.

  6. Acted for a major telecommunication company in a taxation dispute valued at Kes 400 million, leading to the successful setting aside of the erroneous bill of costs of Kes 400 million.
